• User Content

You agree not to submit any User Content unless you have the right to do so and to grant CasinoLogin an irrevocable, non-exclusive, transferrable, fully paid-up, royalty-free worldwide license (with the right to sublicense) to use, copy, publicly perform, digitally perform, make, have made, sell and distribute your User Content as well as all modified and derivative works thereof in any media now known or hereinafter created. This license will survive the termination of your CasinoLogin account.

You represent and warrant that none of your User Content is subject to a confidentiality obligation. You further represent and warrant that you will not submit to CasinoLogin any information or ideas that you consider to be confidential or proprietary. If you do submit any such information or ideas to us, you automatically waive any and all rights that you may have in the information or ideas and acknowledge that CasinoLogin will not owe you any confidentiality or other obligations with respect to the information or ideas.

You understand and agree that CasinoLogin may review and delete any User Content, in whole or in part, if in our sole judgment such User Content violates these Terms of Use, is illegal or may expose us or you to legal liability. We reserve all rights not expressly granted herein in and to the Services.

• You acknowledge and agree that we may, in our sole discretion, refuse to award prizes or winnings to any person or entity that we determine, in our sole discretion, is attempting to defraud us or cheating in any way.
• You acknowledge and agree that we are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers, providers, hardware or software due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including without limitation injury or damage to any person’s computer related to or resulting from participating or downloading materials in connection with the Gaming Services.
• You acknowledge and agree that we are not responsible for any loss or damage of any sort you may incur from dealing with any third party, including without limitation any third party that provides prizes or winnings to you in connection with the Gaming Services.

CASINOLOGIN MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES, UNLESS OTHERWISE SPECIFIED IN WRITING. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

TO THE FULL EXTENT PERMITTED BY LAW, CASINOLOGIN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CASINOLOGIN DOES NOT WARRANT THAT THE SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES, CASINOLOGIN’S SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM CASINOLOGIN ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. CASINOLOGIN WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SERVICES, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

• Indemnification

You agree to indemnify, release and hold us and our affiliates and our and their respective directors, officers, employees, contractors, agents and licensors harmless from any claims (including third party claims), liabilities, damages, losses and expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your access to or use of the Services.

In the event that any provision of these Terms of Use is determined to be unlawful, void or unenforceable by a court of competent jurisdiction, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Use, such determination shall not affect the validity and enforceability of any other remaining provisions.

We may terminate your access to all or any part of the Services at any time, with or without cause or notice to you. You may discontinue your participation in and access to the Services at any time. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
